The Japan Times - ICC President Akane Warns U.S. Sanctions Threaten Court's Future

Tomoko Akane, the president of the International Criminal Court, warned that United States sanctions are pushing the institution to a critical juncture, stating that further escalation could threaten both the court's future and the international rule of law. Speaking remotely during an online news conference hosted by the Japan National Press Club on August 26, Akane emphasized that if the ICC were dismantled, the world would enter a process where the rule of power replaces the rule of law.

The International Criminal Court reported that thirteen prosecutors and judges, including Akane, are currently subject to U.S. sanctions. These measures have created significant difficulties in their daily lives, specifically resulting in the loss of access to U.S. bank accounts and credit cards. Additionally, the sanctions prevent them from booking flights and accommodations through websites owned by U.S. companies.

Despite these operational and personal challenges, Akane stated that staff morale within the court remains very high and that ongoing proceedings will continue without disruption. She declared that the court would not give up and would resist with everything it has to ensure it is not destroyed by threats. Akane asserted that justice should always prevail over its opposite.

Akane noted that she has received support from many countries, particularly in Europe, as well as from international organizations including the United Nations and the European Union. She also cited support from bar associations and nongovernmental organizations in Japan and abroad. Regarding the Japanese government's response, Akane described it as a great source of strength for both herself and the ICC. She expressed confidence that Japan, as a U.S. ally, would continue engaging Washington on the issue.

Akane stated her confidence that Japan would express its views on the importance and legitimacy of the ICC, continue dialogue in a positive manner, and help ensure that the situation does not lead to further escalatory actions by the United States. She indicated that she is confident Japan will help prevent further escalation.

The pressure from the sanctions has also taken a personal toll on Akane. She recalled an incident where security personnel presented her with a bouquet of sunflowers as they escorted her home, a gesture meant to acknowledge the strain caused by the sanctions. Akane remarked that while she is strong when under attack, kindness touches her deeply and there have been times when she broke down in tears at home.

Even so, Akane said she took the heartfelt gesture as a reminder that she and her colleagues must keep fighting to ensure the ICC can continue its mission. She described the current period as a critical moment for all states parties and for the court itself. The warnings come amid ongoing diplomatic tensions regarding the scope and impact of U.S. measures against international judicial bodies.
