Worth knowing:
137 years ago (as of 1 July 2025), the Japanese daily newspaper "THE JAPAN TIMES" was founded by the publicist Motosada Zumoto and appeared for the first time on 22 March 1897. "THE JAPAN TIMES" is considered the oldest and largest English-language daily newspaper in Japan. At the same time, "THE JAPAN TIMES" is an influential voice in the Japanese media landscape and is committed to independent journalism and diversity of opinion on a daily basis. "THE JAPAN TIMES" thus plays an important role in Japan's media landscape in terms of shaping public opinion and is considered an example of traditional quality journalism in the Japanese capital. As a daily newspaper, "THE JAPAN TIMES" reports on local and national news, politics, business, culture and sport in its new edition, which is published seven days a week, around the clock, in six languages (German, English, Spanish, Portuguese, Italian and French).

Legal basis:
Digital Services Act of Germany (DDG): Regulations for providers of telemedia (formerly Telemedia Act of Germany, TMG), in particular obligations for provider identification, liability regulations and transparency requirements. Interstate Broadcasting Treaty (RStV): Regulates the requirements for broadcasting and telemedia in Germany, in particular with regard to responsibility for content. Mediendienstestaatsvertrag (MDStV): Predecessor regulation to parts of the Interstate Treaty on Broadcasting and Telemedia of Germany, replaced by the DDG and the Interstate Treaty on Broadcasting and Telemedia of Germany.

Liability for content:
According to §§ 8 to 10 DDG, we as a service provider are not obliged to constantly monitor transmitted or stored third-party information or to search for illegal actions. This does not affect our obligations to remove or block the use of information in accordance with general legislation. We can only be held liable from the moment that we become aware of a specific infringement. If we become aware of any such infringements, we will immediately remove the content concerned. The place of jurisdiction is Berlin (Federal Republic of Germany).

Data protection and data processing agreement:
"JAPAN TIMES" (TJT), a media division of LEGIER Beteiligungsgesellschaft mbH, has concluded a data processing agreement with the provider of the "JAPAN TIMES" websites in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG of Germany). This ensures that the requirements for the protection of personal data are met (including Article 17 of the EU Data Protection Directive and Article 28 of the GDPR).

Network Enforcement Act (NetzDG of Germany):

Press laws and freedom of the press:
"JAPAN TIMES" adheres to the applicable press laws, in particular the Berlin Press Act of 15 June 1965. According to Article 5, paragraph 1, sentence 2 of the Basic Law for the Federal Republic of Germany (GG), freedom of the press is guaranteed. The press is free and serves the free and democratic basic order. Limitations on the freedom of the press are only permissible if they are based on the Basic Law itself and the laws based on it.

The task of the press according to the Berlin Press Act (§ 3):
The press performs public functions by procuring and disseminating news, taking a stand, criticising and contributing to the formation of opinion. These regulations apply throughout Germany in all 16 federal states.

Journalistic right to refuse to give evidence and ban on confiscation:
In criminal proceedings, journalists have a special right to refuse to give evidence (section 53, paragraph 1, no. 5 of the Code of Criminal Procedure / Federal Republic of Germany). In addition, there is a ban on the confiscation of journalistic material (section 97, paragraph 5 of the Code of Criminal Procedure). Restrictions are only permissible if a judge orders them after carefully weighing up the freedom of the press.

Reporting and limits of criticism:
"JAPAN TIMES" reports critically, without defamation or incitement to hatred (§§ 130, 185 StGB / Criminal Code of the Federal Republic of Germany). Any discrimination of minorities is excluded. In this regard, the "JAPAN TIMES" refers to the Berlin Press Act of 15 June 1965 (GVBl. Berlin p. 744) *), last amended by the Act of 3 July 20036), here based on § 3 ‘Ö Public function of the press’, in which it literally states in paragraph 3 of the law: ’The press exercises legitimate interests within the meaning of § 193 StGB (Criminal Code of the Federal Republic of Germany) when it procures and disseminates news, comments, criticises or otherwise contributes to the formation of opinion in matters of public interest. ‘The editorial offices of "JAPAN TIMES" are committed to the free democratic basic order and respect the limits of what is legally permissible. Opinions of the population are duly identified.

Commission on Concentration in the Media (KEK):
"JAPAN TIMES" supports the work of the KEK, which was set up in 1997 on the basis of the 3rd State Broadcasting Treaty, and publishes news, information, video and picture services against this background.

Violations of personal rights:
In the event of violations of personal rights, such as abusive criticism of editors, injunctive relief and damages will be sought in accordance with §§ 823 para. 1, 1004 BGB (Civil Code of the Federal Republic of Germany). The place of jurisdiction is Berlin, Federal Republic of Germany.
